Chief Justice Beverley McLachlin Supreme Court of Canada 301 Wellington Street Ottawa, Ontario K1A 0J1 Dear Madam Chief Justice McLachlin, It is with mixed emotions that I present you and your colleagues with a copy of Shooting the Messenger, a true crime story. I decided to tell my story after Foreign Affairs repeatability blocked every avenue of redress using as an excuse the decision by the late Right Honourable Chief Justice Brian Dickson to deny the appeal of my dismissal from the Canadian Public Service on bogus insubordination charges. He said it was not “a question of national interest”, therefore not worth the Court’s valuable time. The Federal Court was not of that opinion, which is why they made it possible for me to seek satisfaction from the highest court in the land. After the Court of Appeal had rendered its decision, the Court Clerk motioned to me not to leave just yet. After the phalanx of government lawyers and senior officials had left the room she volunteered the following information: “They believe you,” she said “but their hands are tied by section 28 of the Federal Court Act that requires you to prove, not only that an injustice has been done, but that it was done out of malice.” “They believe that given the chance you will take this to the Supreme Court, which is why you will be getting the order of dismissal in writing. With this written notification you can appeal their decision to the Supreme Court, asking that Court ‘when there is clear evidence of injustice, is the Federal Court bound by section 28 of the Federal Court Act.’ ” (Shooting the Messenger, In the Federal Court of Appeal, p.133) Due to circumstances beyond my control (Shooting the Messenger, Et tu, Brute) I missed the deadline for filling. The Court granted me an extension, accepting my argument that the pursuit of justice should not be a function of time. If you share that sentiment will you not allow an appeal of the Federal Court of Appeal Decision in Bernard Payeur v. Her Majesty the Queen in Right of Canada (File A-399-86) made so long ago, and answer the question asked by Judges MacGuigan, Pratte and Marceau as to whether government regulations trump justice and equity and perhaps finally get me the justice I seek.
